The overtime threshold is the salary level that helps decide which employees are owed overtime for working more than 40 hours in a workweek. This 90-minute webinar on the DOL overtime threshold explains how a proposed increase would affect employers and employees, and how to review exempt and non-exempt status.

Under the Fair Labor Standards Act, non-exempt employees earn at least one and a half times their regular rate for hours over 40 in a seven-day workweek. Exempt status depends on the salary threshold and job duties, not job titles, and isn't simply blue collar versus white collar.

Misclassification is one of the most common compliance mistakes, and it can spill over into attendance, timesheets, payroll and benefits problems.

  • Explain how the overtime salary threshold works under the FLSA
  • Apply the duties test to classify exempt and non-exempt employees
  • Estimate how a higher threshold affects classification and budget
  • Describe the rulemaking steps from proposal to implementation
  • Train managers and supervisors to support compliance
  • Build a plan to prepare for overtime rule changes

  • Why the DOL proposed a new overtime rule
  • How the proposed increase would shift employee classification
  • How the rule would affect the employer's budget
  • How the 2020 overtime rule left employers unprepared
  • Resources and guidance offered to employers
  • How the duties test separates exempt and non-exempt employees
  • Classifying employees correctly to avoid fines and penalties
  • How the FLSA gives employers resources to manage the process
  • The steps of the rulemaking: proposal, public comment period, publication and implementation
  • Training managers and supervisors on the changes as part of risk management
  • Preparing for the rule with confidence

Whether an employee is hourly or salaried isn't left entirely to the employer, and getting it wrong can mean fines and penalties. A change to the salary threshold can shift employees' classification and affect your budget, so employers need to review their workforce before any new rule takes effect.

The session suits employers in all industries, business owners and leadership, compliance professionals, payroll administrators, HR professionals, and managers and supervisors.
